Terms and Conditions

1. Acceptance of Terms

By accessing or using ChangelogAI ("the Service"), you agree to be bound by these Terms and Conditions. The Service is operated by DviewB & Mycd. If you do not agree to these terms, please do not use the Service.

2. Description of Service

ChangelogAI is a Software-as-a-Service (SaaS) platform that automatically generates human-readable changelogs from GitHub repository commits using artificial intelligence. The Service includes a dashboard for managing projects, public changelog pages, and subscriber notification features.

3. Account Registration

• You must create an account to use the Service. You are responsible for maintaining the confidentiality of your credentials.
• You must provide accurate and complete information when registering.
• You are responsible for all activities that occur under your account.
• You must be at least 18 years old to use the Service.

4. Subscription Plans and Billing

ChangelogAI offers the following plans:

• All prices are in Euros (€) and exclusive of applicable VAT.
• Payments are processed securely by Stripe. By subscribing, you authorize recurring charges to your payment method.
• Yearly plans are billed annually in advance.
• Monthly plans are billed monthly in advance.

5. Cancellation and Downgrade Policy

• Cancellation takes effect at the end of the current billing period. You retain paid features until that date.
• If you have more projects than the Free plan allows (1 project), existing projects remain visible but new generations are restricted until you are within Free plan limits.
• No refunds are issued for partial billing periods, except where required by applicable law.
• You may cancel your subscription at any time through the billing portal accessible from your dashboard.

6. Refund Policy

• We offer a 7-day refund for new subscribers who are not satisfied with the Service, provided no more than 10 changelog generations have been used.
• Refund requests must be submitted to help@dviewb.com within 7 days of the initial purchase.
• Yearly plan refunds after the 7-day period are evaluated on a case-by-case basis.
• We reserve the right to refuse refunds in cases of abuse or violation of these Terms.

7. Acceptable Use

You agree not to use the Service to:

• Violate any applicable laws or regulations
• Infringe the intellectual property rights of others
• Connect repositories containing illegal, harmful, or malicious content
• Attempt to reverse engineer, decompile, or circumvent the Service
• Use automated scripts to abuse the API beyond reasonable usage
• Resell or redistribute the Service without written authorization

8. Intellectual Property

• The ChangelogAI platform, including its design, code, and branding, is the exclusive property of DviewB & Mycd.
• Content you generate using the Service (changelogs) belongs to you. You grant us a limited license to display and process this content as necessary to operate the Service.
• Commit data accessed from your GitHub repositories remains your property. We process it solely to generate changelogs.

9. AI-Generated Content

ChangelogAI uses Anthropic's Claude AI to generate changelog content. By using the Service, you acknowledge that:

• AI-generated content may occasionally be inaccurate or incomplete.
• You are responsible for reviewing and approving all generated content before publishing.
• We do not guarantee the accuracy, completeness, or fitness of AI-generated changelogs for any particular purpose.
• Commit messages you submit are processed by Anthropic's API in accordance with their usage policies.

10. Service Availability

• We strive to maintain high availability but do not guarantee uninterrupted access to the Service.
• We reserve the right to perform maintenance, which may result in temporary service interruptions.
• We will notify users in advance of scheduled maintenance where reasonably possible.

11. Limitation of Liability

To the maximum extent permitted by applicable law, DviewB & Mycd shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of or inability to use the Service. Our total liability shall not exceed the amount paid by you for the Service in the 12 months preceding the claim.

12. Termination

• You may terminate your account at any time by contacting us or deleting your account from the dashboard.
• We reserve the right to suspend or terminate accounts that violate these Terms.
• Upon account termination by the user, all data will be permanently deleted within 30 days.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of significant changes via email or through the Service. Continued use of the Service after changes constitutes acceptance of the new Terms.

14. Governing Law

These Terms are governed by the laws of Italy. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Italy.
